The Role of Positive and Shari'ah Non-Custodial Sanctions in Addressing Prisoners’ Problems: An Analytical Study

This study aims to explore the most effective treatments to issues of Yemeni prisoners in light of the positive criminal policy and Islamic Shari'ah. The comparative-analytical method was used to analyze and compare the treatments. The findings demonstrate that the Maqasidi approach, which addresses issues by considering their underlying objectives, which treats each issue in isolation. The results also indicate that the Maqasidi approach necessitates the application of non-custodial sanctions, particularly those known as alternatives to imprisonment, restorative justice measures, and Shari'ah sanctions. The findings also show that there is a deficiency in the application of Shari'ah non-custodial sanctions in Yemen and in Muslim countries in general.
